  4. Marion Barry's trial ends with both sides claiming victory

  7.     During six weeks of sordid testimony, the drug and perjury
  8. trial of Mayor Marion Barry divided Washington. Barry's
  9. supporters, mostly black and mostly poor, charged that he had
  10. been unfairly hounded by a vengeful federal prosecutor
  11. determined to drive a powerful black elected official from his
  12. post. The mayor's critics, largely white and mainly middle
  13. class, argued that Barry's use of crack cocaine had disgraced
  14. the city and undermined the fight against drugs. Thus the
  15. divided judgment that the jury rendered last week after eight
  16. days of deliberations seemed oddly appropriate. The panel
  17. found Barry guilty of one misdemeanor count of possessing
  18. cocaine and acquitted him on a second drug possession charge
  19. but deadlocked on 12 other counts, including three felony
  20. charges of lying to a grand jury.

  22.     The mixed verdict allowed both sides to claim a partial
  23. vindication. U.S. Attorney Jay Stephens boasted that it proved
  24. "no man is above the law." Though the government could retry
  25. Barry on the charges for which no verdict was reached, it may
  26. decide not to do so. Nor is there much chance that Barry will
  27. be sent to prison for the misdemeanor conviction. Had Barry
  28. been found guilty of a felony, he would have been prohibited
  29. from holding elected office. Now he is free to run again,
  30. perhaps for the city council.

  32.     During the trial, government witnesses testified that Barry
  33. used drugs -- cocaine, opium and marijuana -- more than 200
  34. times in homes and hotels, on ships and even at the 1988
  35. Democratic Convention. A videotape of an FBI sting operation
  36. last January showed the mayor twice inhaling from a crack pipe
  37. in a downtown hotel room to which he had been invited by a
  38. former girlfriend, ex-model Rasheeda Moore. The mayor's lawyer,
  39. R. Kenneth Mundy, derided the government's witnesses as "little
  40. Lucifers" and charged that Barry had been the victim of an
  41. outrageous government vendetta.

  43.     If Barry's trial is over, his beleaguered city's is still
  44. under way. Washington faces a record number of drug-related
  45. homicides, a crack epidemic, growing pockets of intractable
  46. poverty and a shrinking middle-class tax base. At the top of
  47. the list are the racial animosities that Barry's ordeal brought
  48. to the surface. Says Howard University political scientist Ron
  49. Walters: "There's going to be one hell of a mending job that
  50. has to be done along the line."
